Normalde kişiler bir suç işlediklerinde tutukevine yollanır ve mahkeme günlerini beklerler. Ama yargı isterse belirli bir bedel karşılığında (kefalet) kişiyi mahkeme gününe kadar salabilir.

Türkiye'de tutukevleri ve cezaevleri maalesef aynı binalar oldukları için kafamız karışsa da, normalde tutukevlerinde zanlılar, cezaevlerindeyse mahkumlar kalır. İşte kefalet kişinin tutukevinde kalmamak için ödediği bedeldir.
